Student privacy and consent

Marking.ai processes student work as part of marking. If you’re rolling it out for the first time, or having a conversation with parents or your school, here’s some guidance on how to talk about it.

What Marking.ai does with student work

When you upload a student submission:

It’s processed by Marking.ai’s marking engine to produce marks and feedback
It’s stored securely against your account
It’s used to power your insights views and exports
It’s used in aggregated, de-identified form to improve Marking.ai’s marking quality

It isn’t:

Sold to third parties
Used to train public-facing AI models on identifiable student work
Visible to other teachers (unless you share via a share link)
Visible to students unless you share with them

A simple way to explain it to parents

“Marking.ai is a tool I use to help mark assessments faster. It processes the work your child submits to me, gives me initial marks and feedback to review, and I check and edit those before sharing them. The work is stored securely and isn’t visible to anyone else outside our school.”

What to check with your school

Before using Marking.ai widely, you may want to:

Talk to your school’s data protection lead — some schools have specific policies on third-party AI tools
Check your existing parent consent language — some schools already cover “third-party services” in their general consent
Make sure your sharing patterns align with school policy — e.g. emailing results to a parent vs. handing over a printed report

What students see

A student opening a share link sees:

Their own marks and your feedback
The marking guide (if you’ve left it visible)

They don’t see the marking guide they didn’t get a mark for, other students’ results, AI confidence indicators, or any teacher-only data.

Marking.ai is designed to support GDPR (UK and EU), FERPA (US, where applicable), and equivalent regulations elsewhere. For specifics, see our privacy policy at the bottom of marking.ai. For school-level data agreements, drop us a line at connect@marking.ai.

If a student or parent wants their data removed

You can:

Archive the student — keeps the data but removes it from active views (see Editing, merging, and archiving students)
Delete the submission — see Deleting submissions
Delete the assessment — see Deleting an assessment
Close the account — see Deleting your data or your account

For a formal data-deletion request, email connect@marking.ai and we’ll act within the relevant statutory window.

Yes — it’s designed for use in schools, with the appropriate school-level consent and policy in place.

What if my school requires a Data Processing Agreement?
